Employers Cannot Dismiss A Working Woman While She Is On Maternity Leave

According to Saudi Lawyer Jaafar Jamal Al-Layl, an employer should not dismiss a working woman on maternity leave or threaten her with dismissal.

During maternity leave, the employer may not dismiss the working woman or warn her of dismissal, according to the Saudi regulator.

According to the regulator, an employer cannot dismiss a pregnant woman during her illness. If her absence did not exceed 180 days, a medical certificate is required to prove the disease.

One of the most legitimate reasons is the termination of the employment contract, or if both parties agree to terminate the contract, or force majeure, which occurs during the 180 days prior to the expected delivery date. Medical care must be provided to the working woman during pregnancy and childbirth by the employer.
