Expat Workers Hired By Yellow Status Companies Do Not Need Work Permits

According to Saudi Arabia's Ministry of Human Resources and Social Development, no work permits will be issued to newly hired expat workers of companies and establishments that fall under the 'Yellow' category of the Updated Nitaqat Saudization program.

According to the Ministry, a work permit could be issued to a newly recruited foreign worker in a company that falls within the yellow category of the Updated Nitaqat system.

According to the Ministry, expat workers in yellow category companies will not be able to renew their work permits if they spend more than 6 years in the Kingdom.

Nitaqat's yellow status will be removed in 2020, and companies in the yellow category will be shifted to the red band and considered noncompliant with Saudization levels until their status improves. Downgraded companies cannot apply for new expat visas, change their expat workers' professions, or renew their work permits.

The Ministry started implementing the Updated Nitaqat program on 1st December 2021, which is in line with the Ministry's labor market strategy that aims to enhance market efficiency and provide new attractive jobs for young Saudis.

According to the ministry, the updated Nitaqat system aims to increase and expand job opportunities, increase Saudi citizens' participation in the labor market, and contribute to the kingdom's GDP. The program targets more than 340,000 jobs within 3 years. In 2011, Nitaqat was launched with the aim of encouraging Saudization of jobs in the private sector and setting a minimum salary for Saudi nationals.
