According to Majed Al-Quait, the Human Resources consultant in Saudi Arabia, an employee is entitled to claim an end of service gratuity if his or her contract is terminated by the employer.
Al-Quait explained to Al-Ekhbariya that if the employer asks the employee to resign and the employee proves this, it is considered dismissal and the employee is entitled to an end-of-service gratuity.
- There are several reasons for termination, either there is a violation of the employer or an employee is in violation, termination of the contract, reaching the age of contract or closing the project, in which case the employee is not entitled to compensation, however, he will receive an end of service gratuity and the disbursement of vacation balances in addition to an experience certificate.
- According to Malak Al-Fadl, a legal advisor, the employment contract is a contract between employer and employee.
According to her, one of the most important aspects of an employment contract, mentioned in Article 52 of the Law, is to include the name and address of the employer, the name and nationality of the worker, as well as the salary, benefits, allowances, the duration of the contract and the date of joining the company.
In addition to setting the wage and providing health insurance, the employer must register the worker in social insurance (GOSI) and provide paid annual leave after signing a contract.
The worker must adhere to the work ethic, not divulge work secrets, whether technical or commercial, and not destroy the place's or device's property.
