In Saudi Arabia, Employing An Illegal Is Punishable By 15 Years In Prison

Saudi Arabian Public Prosecution warned against employing the illegal in the Kingdom, stating that it is a crime punishable by imprisonment for a period of 5 to 15 years, as well as a fine of 1 million riyals.

In a tweet on Twitter, the Public Prosecution said that employing the illegal into the Kingdom is prohibited, and the penalties can range from imprisonment up to 15 years, a fine of one million riyals, and the seizure of the means used to commit the crime."

The prosecution explained that, "The summary of the such judgment will be published at the expense of the convict after he receives the final judgment," highlighting that infiltrating the Kingdom is a serious crime requiring arrest.

Clarifications from Public Prosecution regarding Commercial Data :

Commercial data are the details to be placed on goods and products, directly or indirectly, to identify them or their qualities. Earlier, the Public Prosecution had said that commercial data are the details to be placed on goods and products.

- The commercial data law clarifies the number of goods, their quantity, size, agent, weight, price, production and expiration dates, as well as the company or nation in which the product was manufactured and the elements of its composition.

The term also refers to the capability of holding a license or other property rights, as well as privileges or awards for commercial or industrial activity, as well as the name or for which certain goods are known or are usually performed.

As per the commercial data law, the commercial statement is required to be written in Arabic at least and to be true in all respects, whether it is addressing, covers, invoices, letter papers, advertising means, or any other means used in displaying goods to the public.

When the amount, size, measure, energy, weight, source, or components of the products are among the factors that can be used to estimate their value, a decision from the Minister of Commerce may prohibit the import, sale, or offering for sale of these products unless they feature one or more of the statements obtained from this data.

It shall be specified in a decision by the Minister of Commerce how the data shall be placed on the products and how to replace them if this is not possible.

- The Board of Grievances may order the confiscation of the seized items, the sale of what can be sold thereof, the deduction of its value from any compensation and fines ordered, or the destruction of the remainder of the seized items. Moreover, the Court may also order that the decision issued for conviction, confiscation or destruction be published in one of the daily newspapers issued in the convict's residence area at his expense.
