A Saudi labour court ordered a medical complex in one of the governorates to pay a Saudi doctor 280,000 riyals in due salary and end of service gratuity, after terminating his services, local media reported.

The court also ruled the clinic be fined 200,000 riyals due to its unjustified delay in paying the consultant doctor’s dues and the doctor be awarded experience certificate for his work period.

The doctor told the court the clinic ended his job contrasct without a legitimate reason.

He demanded the clinic pay him salaries, end of service benefits, and compensation for termination of his contract according to article 77 according of the labour law

The doctor submitted to the labour court bank statements showing his 46,000 riyal monthly salary and his job contract.

Lawyer Sarah Thabet explained to Okaz that the labour laws stipulate that if the work relationship ends, then the employer must pay the worker an end of service gratuity, calculated on the basis of half a month’s wage for each of the first five years, and a month’s wage for each subsequent year

She added the rules obliged the employer to to give the worker — upon his request — a service certificate free of charge, which clarifies the date of joining the work, the date of termination of relationship, profession and the amount of last wage. The employer may not include in the certificate any information that may damage the reputation of the worker, or reduce his job opportunities.

The lawyer added that the labour courts are competent to hear cases related to the labour laws, including disputes related to job contracts, wages and dues, work injuries and compensation for them, as well as disputes related to disciplinary penalties against the worker, cases brought to impose penalties stipulated in the labour laws, and disputes arising from the application of labour laws and social insurance system.

Saudi Ministry of Justice has announced that the labour courts had achieved its 30 day target, that a case takes in the court of first instance, with the average case settlement time becoming 22.94 days, and 3.37 hearing, in a bid to save time and effort and achieve prompt justice.
